Terms of Service

These terms are the agreement between you and the company that operates Podvidi. Please read them before you record.

1. Who you are contracting with

Podvidi is operated by Consultant Infonuagique Inc., a corporation continued under the laws of Ontario, Canada. "We", "us" and "Podvidi" mean that company. "You" means the person who opens an account, and where an account is opened for an organization, that organization as well. Podvidi also operates a physical recording studio in Morocco; using that studio brings in the additional terms in section 11.

2. What the service is

Podvidi gives you a room to record in — in person at the studio, or in your browser with remote guests — and then keeps what you recorded, transcribes it, and publishes it if you want it published. We provide the studio, the software and the hosting. We do not produce your show.

3. Your account

You must give a real email address and keep it current, because it is how we reach you and how you recover access. Keep your password to yourself. Turn on two-factor sign-in if your account matters to you. You are responsible for everything done through your account, including by anyone you invite into your workspace, until you tell us it has been compromised.

You must be old enough to enter a contract where you live. Podvidi is not for children.

4. Your workspace and the people in it

Every account gets a workspace. The workspace owner controls billing and can invite admins and members. Whoever owns the workspace controls its recordings and its subscription — if you record on behalf of an employer, expect the employer to be the owner.

5. What you may record

The Content Policy is part of these terms and you agree to it by using the service. It says what you must not record, and it says that everyone in a recording must know they are being recorded and agree to it. That consent is your responsibility to obtain and it is not something we can obtain for you.

6. Your recordings belong to you

You keep every right you have in what you record. You give us only the permission we need to actually run the service for you: to store your files, move them between our systems, transcode them, generate transcripts and search indexes from them, and — only where you ask us to publish — transmit them to the people you publish to. That permission is limited to operating Podvidi, is not exclusive, and ends when you delete the content or close your account, except for backup copies that age out on their normal cycle.

We do not use your recordings to train models, and we do not sell them, license them or hand them to anyone except as section 7 of the Privacy Policy describes.

7. Plans and payment

The free plan lets you book and hold a session. It does not include recording storage: its storage allowance is zero, deliberately, and the product will tell you so before you rely on it.

The paid plan is billed monthly in advance through PayPal at the price shown on the pricing page at the time you subscribe. It renews every month until you cancel. You can cancel at any time and you keep what you have paid for until the end of the period you paid for; we do not refund part of a month. If we change the price, the new price applies to your next renewal and we will tell you at least 30 days beforehand, so you can cancel first if you would rather not pay it.

Each plan carries a monthly recording allowance and a storage allowance. Going past either one stops new recording, not access — everything already in your archive stays there to play and download.

8. Availability

We try to keep Podvidi up and we do not promise that it always will be. There is no uptime commitment in this agreement. We may change, add or withdraw features. If we withdraw something you depend on, we will give you notice and time to get your files out.

9. Suspension and termination

You may close your account whenever you like. We may suspend or close an account that breaks these terms or the Content Policy, that has not paid, or that is being used in a way that threatens the service or another person — immediately and without notice where something is unlawful or someone is at risk, and with notice otherwise. If we close your account for a reason other than your own breach, we refund the unused part of what you paid.

10. What we are responsible for, and what we are not

We provide the service as it is. Equipment fails, uploads fail and networks fail. We work to make every session safe and recoverable, and we do not guarantee that a recording will be captured, will be complete, or will be of any particular quality.

To the fullest extent the law allows: we are not liable for indirect, incidental or consequential loss, for lost profit, or for lost or corrupted recordings beyond the amounts below; our total liability for any claim relating to a single recording session is limited to what you paid for that session; and our total liability under this agreement is limited to what you paid us in the twelve months before the claim arose.

Nothing here excludes liability that cannot lawfully be excluded, including for death or personal injury caused by our negligence, or for fraud.

11. Using the physical studio

When you are in the studio: follow the operator's instructions, look after your own belongings, and expect to be responsible for damage you or your guests cause to the room or the equipment. Studio bookings are subject to the cancellation terms shown when you book. The Recording Waiver applies to every session in the room.

12. Changes to these terms

We may update these terms. When we do, we publish a new version on this page with a new effective date. A change that materially affects you takes effect no sooner than 30 days after we publish it, and we will write to the address on your account before it does. Carrying on after that date means the new version applies to you; if you would rather it did not, cancel before then.

The Content Policy and the Recording Waiver work differently: the product asks you to accept those, and what you accepted is stored with the text exactly as it read on the day you accepted it.

13. Law, and where a dispute goes

This agreement is governed by the laws of the Province of Ontario and the federal laws of Canada that apply there, and the courts of Ontario have jurisdiction. If you use the studio in Morocco, Moroccan law governs your presence on those premises and the recording of people there, and nothing in this section takes away a protection Moroccan law gives you.
